Terms & Conditions of Hire
*MUST READ BEFORE HIRING PHOTO BOMZ STUDIO
*The following “Terms & Conditions of Hire” will be emailed to the Client or contact person in charge of hiring our Company, stating they have read and agreed by initialing and dating this document.
Definitions
1.1 The “Client” means the person/s, organization or company booking the equipment, act or entertainment
with the “Company”.
1.2 The “Company” means Photo Bomz Studio, LLC.
Bookings
2.1 All equipment (including supplied props, backgrounds, and all other supplies) always remains the property of the company.
2.2 By placing an order with us either verbally, online or via e-mail regardless of whether an Event Service Agreement has been returned, or deposit paid, it is deemed that the customer has read, understood, fully agreed to and is bound by all of our terms and conditions of hire.
2.3 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfill our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event, or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid
irrespective of any loss of earnings.
Prices, Deposit & Balance Payments
3.1 All hires are subject to a $200.00 holding deposit, to secure the services of the company. Promotional offers require full payment at time of booking.
3.2 The client must pay the deposit at the time of booking to fully secure the requested date(s), or within 7 days from the date the booking is made, at our discretion.
3.3 Deposits are non-refundable unless cancelled within 3 business days from date booked.
3.4 The balance is to be paid in full and cleared at least 14 days prior to the event start date.
3.5 Advertised prices are subject to change without prior notification, and any future promotional offers will not apply to this booking. However, the price agreed at the time of booking will remain in force.
3.6 For bookings on Memorial Day Weekend-Friday thru Monday, Independence Day-July 4th, Christmas Eve, New Years Eve, Good Friday or Easter Sunday, all fees will be charged at 1.5 x the standard rate. Closed New Year’s Day, Labor Day, Thanksgiving Day, and Christmas Day.
Cancellations
4.1 Cancellation of your order will incur charges as follows, based on the number of days prior to the scheduled event date when the cancellation is notified:

Less than 14 days before the event: No refund will be provided.

60 days or more before the event: Only the deposit will be forfeited, minus any charges already incurred.
Equipment
5.1 The Client acknowledges that it shall be responsible for any damage or loss to Photo Bomz Studio, LLC’s equipment (including props, backdrops, and any other supplies) caused by any misuse of our equipment by its customers or its guests or any theft or disaster (including, but not limited, to fire or flooding) at the client’s event.
5.2 All goods remain the property of the company at all times. The props are for use in the booth area only and not to be taken away from the booth area.
Site Location, Facilities & Conduct
6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.
6.2 If access to the venue is delayed for any reason, or events over-run delaying the start of your hire period, no refund shall be given, nor shall the hire period be extended beyond the original finish time without explicit agreement from us.
6.3 The client is responsible for ensuring that the venue has sufficient space available for the booth, and the venue management have been notified.
6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.
6.5 The company reserves the right to refuse entry to the booth area of any guest(s) behaving inappropriately. We want you all to have fun, but your safety and the prevention of damage to our equipment always takes precedence. We will not tolerate any form of abuse directed towards our staff.
6.6 Set up- For optimal setup, the Majestic Mirror requires an area of approximately 8 feet by 8 feet to properly display mirror, printer, backdrop, and all available props. The Elite Bomb Shell needs a smaller space, ideally 6 feet by 8 feet. We will endeavor to optimize any available space to best accommodate both the guests and the client.
The client is responsible for ensuring the provision of a suitable space and a standard 3-prong, 110V electrical outlet located within 6 to 10 feet of the designated area for the hired booth.
6.7 Due to the position of the camera, the booth is unsuitable for unsupervised use by small children. We welcome children into our booth but may insist they are accompanied by an adult.
Liability & Insurance
7.1 The company's liability insurance covers the use of the equipment only when it is booked on a 'wet hire' basis, which requires supervision by a company representative.
7.2 Indemnification by the Client: The client agrees to indemnify and hold harmless the company against any and all claims, damages, losses, liabilities, and expenses arising from damage to or theft of the company’s equipment during the rental period.
7.3 Limitation of Liability: The company is not liable for any personal injury, damage, or loss of personal property arising from the use of the hired equipment. Users assume all risks associated with the use of the equipment.
Use of Images
8.1 The client gives Photo Bomz Studio, LLC permission to use images taken at their event to be used on Photo Bomz Studio’s website, social media pages and for advertising and promotional purposes.
8.2 Photo Bomz Studio will not use any images that are deemed unsuitable on the website or for advertising purpose and will not use any content that maybe personally damaging to the person(s). We are a distinguished and professional business, committed to treating all customers, clients, and guests with the utmost respect and care.
We take the privacy and safety of minors seriously. Any images of children under 18 years old will be used with care and only for the purposes agreed upon. We will not share or distribute these images without explicit parental consent. It is the responsibility of the client or event organizer to inform us if any individuals under 18 will be photographed. If it is discovered that an individual under 18 was photographed without our knowledge, we cannot be held liable if they appeared to be over 18. However, upon learning of such a situation, we will take immediate steps to ensure compliance with our privacy policy, including removing or restricting the use of the images as appropriate.
8.3 Retention of Images: We will keep a digital copy of your photographs for 60 days after your event, at which point they’ll be deleted permanently.
Hiring, Delivery and Service
9.1 Delivery set up and removal of the equipment is included in the total amount paid for the hire period.
9.2 Time taken to deliver, set up and remove the equipment will be outside the hire period.
9.3 A fully trained representative of the company will be on site throughout the hire of the equipment.
9.4 Guest Book or Photo Album: We will make every effort to maintain your guest/photo book in the condition it was provided, should we be responsible for overseeing it. We cannot be held responsible for damage caused to the book by your guests (e.g. spilling drinks, tearing pages allowing unsupervised children to scribble in them).
9.5 Photo Templates: We will need to know your layout requirements, including any specific colors, text, logos or fonts no later than 2 weeks prior to your event. A proof will be supplied via email for your approval.
